A person has been with a company for 10 years as a Test Lead and is promoted to a position of a manager and the Lead expects that on the first day of being a manager he wants all the rights and benefits of being a manager for 10 years even though he has been a lead for all of those 10 years.

what is this analogy none sense..... u'r a disgrace to eb2...... date porting is codified in the law..... no one can change it but congress....... the problem with congress is that it cannot agree with anything related to immigration...... let's say they decide to do just one thing, just one....... do u truly believe that anybody other than u on this planet would care to stop porting of eligible applicants to eb2?...... pls keep me posted if you send out any communication to anyone for stopping porting.... becoz i'll send double the number of emails and letters to keep porting in place.....
i do have a suggestion for u...... if everyone is porting from eb3 to eb2..... maybe u should stay ahead of the curve and port from eb2 to eb3...... then u will be the only applicants left in entire eb3..... :rolleyes:

No not sure who recieved it as my Lawyer has sent the packages on behalf of me and she has the delivery confirmation.

This is an excellent point. I would like to raise this up in next IV conference call.
Looks like this is a good idea. Even if FB2 is not current, USCIS might allow applying for 485 in such cases.
Maybe someone more knowledgable or from the core members can throw some light on this.

It will not be easy as we love this country too...but then one of the main reasons we are going back is the way is the culture here... I am not very comfortable with the culture here and would like my kids to have the Indian culture...I agree there is a lot of westernization back home too...but I guess there is some hope there still to have a little control on the kids...or help them go the right way...here I am not saying it is wrong...but is a totally different culture....which is what I am not able to digest....

On July 25th lawyer sent my documents 140 & 485 concurrent, PD port from previous I-140 approval (approved at Nebraska).
Reached Nebraska Service Centre on July 26th.
Will it be processed at Nebraska Service centre or Texas Service centre? According to new direct filing instructions my employer and my residence comes under Texas Service centre.
Though I would say pray for TSC !

Average worldwide processing time for employment based green card applications is 1.43 years (Priority Date to GC approval).
In simple words, it takes 5.5 years to wrap up the 1 year GC demand for Indian applicants presuming there is no overflow from any other country GC visa quota.

I thinks EB3 INDIA will move between 9/11/2001 to JAN 2004 , because after 9/11 probably few people applied for GreenCrd because of market condition, even h1b quotas are not used for 2002 and 2003, i applied for h1b on 2004 April , no surprise the quota available because of market condition.

They say that you become what you think most of the time. Do you really think good things about yourself? Try to develop a habit to see silver lining to anything in life...it will take you a long way not only with GC stuff but other issues which we have to deal with day to day.

I don't think the Canadian officers will ask you that question. But like someone else said on this thread that question may be raised by the US officers when you return. I am curious to know about this myself.

What I did till now.
1) Contacted Senator/Congressman/Governor
2) Filled 7001 form for Ombudsman
3) Called USCIS 10 times in last 10 days and come to know that everything is cleared on my and wife applications.
4) Strange thing applied EAD on July 15th 2008 and got approved today august 12 2008.
Did you do all this for EAD?
1) Contacted Senator/Congressman/Governor
2) Filled 7001 form for Ombudsman
3) Called USCIS 10 times in last 10 days and come to know that everything is cleared on my and wife applications.
4) Strange thing applied EAD on July 15th 2008 and got approved today august 12 2008.
Did you do all this for EAD?

Just got back from Canada.
All went smooth. Upon arrival at Toronto (Pearson) Airport, the Landing procedure was very smooth and pleasant. No questions asked about our business in the US at all and about how long we were going to be in Canada. We dealt with 4 different Canadian officials at various points in the landing process and all were very pleasant and easy going.
We stayed in Canada for a week. Liked it. Did a lot of sightseeing and research all over Ontario. We will be going back in December to British Columbia to check that side of the country out and decide where we would live if we move to Canada.
This afternoon (07/10) we flew back to the US. Once again we got no questions about our business in Canada. The US IO did ask how long we were there for.
The AP processing took about 45 minutes and after that we hopped on the puddle-jumper and landed in Baltimore. The US IOs were actually the nicest i have seen (had not left the country since 2000) and i noticed that all the IOs were minorities (middle-eastern, Indian, pacific rim origins).
Overall good trip + we have Canada in our back pocket in case there is no progress with our US GC in the next 12 months. I recommend others to do the same, our whole process took less than 2 years. Plus we did it on our own without any attorney. It is quite straightforward.

It's very frustrating.. TSC is sitting on our application or what? Approx 30K applications are there for July 2nd filer including NSC->TSC transfer(per old NYT report). We see reporting of 1 or 2 receipting a day then few quite days. :mad:
